U.S. DOL Releases Updated FMLA Notice and Certification Forms

On September 4, 2018, the U.S. Department of Labor’s Wage and Hour Division released new model Family Medical Leave Act (FMLS) notices and certification forms.  The new versions have not changed substantively with the exception of the updated expiration date of August 31, 2021. Nevertheless, moving forward, employers should use the new forms. The new FMLA notices and forms are as follows:

WH-382 Designation Notice

Certification forms
WH-380-E Certification of Health Care Provider for Employee’s Serious Health Condition
WH-380-F Certification of Health Care Provider for Family Member’s Serious Health Condition
WH-384 Certification of Qualifying Exigency for Military Family Leave
WH-385 Certification for Serious Injury or Illness of Current Servicemember – for Military Family Leave
WH-385-V Certification for Serious Injury or Illness of a Veteran for Military Caregiver Leave
