Reminder: New York City Employers Must Post and Distribute“Know Your Rights at Work” Poster by July 1, 2024

As we previously reported, beginning July 1, 2024, New York City employers must display and distribute the “Know Your Rights at Work” poster which can be found here: https://www.nyc.gov/assets/dca/downloads/pdf/workers/KnowYourRightsAtWorkPoster.pdf.  The poster contains a QR code that refers employees to the New York City Workers’ Bill of Rights website. 

Employers are required to post the “Know Your Rights at Work” poster in a conspicuous, accessible and visible location in the workplace.  In addition, employers must provide employees with a copy of the poster in English and any language spoken as a primary language by at least five percent of employees, if the information is available in that language on the New York City Workers’ Bill of Rights website. 

New hires must be provided with a copy of the poster on or before their first day of work.  Employers whose business operates online or through a mobile application would also be required to post the workers’ bill of rights online or on such mobile application. 

Employers who fail to comply with the requirements could be subject to civil penalties for violating the notice and posting requirements after a first violation.  The Commissioner of New York City Department of Consumer and Worker Protection will notify a non-compliant employer of any violation and allow it thirty days to remedy the first violation and/or contest the findings. If an employer does not cure the violation within thirty days or commits a second violation, DCWP will impose a $500 civil penalty.

New York City should prepare now to ensure compliance with the new requirements.
