E-Verify Resumes Operations

Since October 1, 2025, the federal government has been shut down due to a lapse in funding causing many governmental programs including the U.S. Department of Homeland Security’s (“DHS”) E-Verify system to cease operations. E-Verify, which allows employers to verify employment eligibility in the United States, has now resumed operations.  Employers can create an E-Verify case for any employee hired while the system was not accessible.

According to guidance released by DHS on October 9, 2025, DHS confirmed that E-Verify operations has resumed. Since E-Verify, myE-Verify, Self Check, and related tools were inaccessible from October 1 to October 7, DHS has issued an extension for employers to present cases.  Employers must create an E‑Verify case for each employee hired while E-Verify was not available by Tuesday, October 14, 2025.  The hire date from the employee’s Form I‑9 must be used when creating the E‑Verify case.  If an employer could not create an E‑Verify case by the third business day after the employee began work for pay because E‑Verify was unavailable, E‑Verify will provide a prompt during case creation to provide a reason for the delay. 

Employers that utilize E-Verify and have hired employees during the time the system was not available, should create a case for those employees by the deadline to ensure compliance.  Should you have any questions, please contact Ali Law Group.
